Question: Assalam alaykum
Can I ask my intended spouse if he is a virgin?
Answer: Wa alaikum assalam wa rahmatullah,
It is not possible to ask your intended spouse if they are virgins, but they are not required and do not have the right to disclose any past mistakes. This is because talking about sin is wrong and sinful, and in this particular context, an example confirming sin would be an example of removing the coverings of Allah from above.
Therefore, you should take care of the issues of net benefit and harm. Lawyers have confirmed that the lady who made the mistake will be considered a virgin, and the same applies to the man. This is contrary to the fact that someone has an active, current and constant dependency or problem, with the result that they will need to solve this issue, since this can immediately affect the marriage.
The main thing is to adhere to the standards of Sacred Law, to uphold these standards in search of a spouse and to give the other side the benefit of doubt. You must ask and investigate those important questions for you, as well as those that are required to protect an Islamic marriage, but not digging out someone’s buried past.
And Allah the Most High knows best.
